Please read the following, by engaging our services you accept and agree to the below “Terms & Conditions of Service” in their entirety.

 

Terms & Conditions of Service – 2 Men and a Truck Waikato Furniture Removals

Hourly Rate: Hourly rate for services is set as per agreement upon negotiation of work required for your particular job.

Quoted Price: Was well as hourly rate work we also provide services at a fixed or quoted price when suitable. If this amount is quoted without GST then this will be clear upon quoting and GST will be added to the final amount due.

Minimum charge is usually 2 hours. This may varies depending on the job, but will be 2 hours unless otherwise agreed. This will be clearly stated in your booking confirmation.

Sunday surcharge: Sunday 10% surcharge applies to all jobs unless waived as per our discretion. This will be clearly stated in your booking confirmation.

Prior Estimate of Time: We endeavour to always provide an honest estimate of the time that it will take to complete a job and will do our best to keep within the estimate provided, but it is an estimate – and the final amount may vary.

Invoicing: Full payment must be made within 24hours of completion of your job, or an invoice being sent/provided. The deposit is required to confirm your booking.

Payment Methods: Payment can be made by Cash or Internet Banking only.

Additional Fees: If payment is not received within 72 hours of your move a $25 admin fee applies. We will allow for weekend delays for bank transfers. If payment has not been made within 8 days a further $75 late payment fee shall be added.

Where full payment, including above fees has not been made within 31 days we will refer the account for collection and by acceptance of these Terms you agree that you will pay all collection costs, including our legal costs as well as any court costs that may be awarded by the court.

Acceptance: Confirmation of your booking with 2 Men and a Truck Waikato Furniture Removals forms a contract for service subject to the above Terms and Conditions.

Breaks: Staff are entitled to take smoko breaks and lunch or dinner breaks. You will not be charged for this time. We would greatly appreciate if you would provide access to toilet facilities and access to water, where available.

Health and Safety: Please ensure you advise us of any known risks such as loose steps, etc. Access and loading areas must be kept clear of debris. Also, children and pets must be kept away from access and loading areas at all times.

Standard of Care: Our standard of care is to blanket wrap all cabinets and large electrical items and ratchet strap them to the wall of the truck. Please point out valuable items requiring extra protection prior to loading.

Excluded Items
To protect the safety of your move and any potential risks, certain items are NOT accepted for transport by Man with a Van Service

1) No Pets and live animals
2) No Flammable substances such as petrol/full LPG cylinders
3) No Dangerous or Hazardous Goods including paint and automotive batteries
4) No engines or unpackaged car parts
5) No perishable or frozen food items
6) No items that cannot be safely lifted/carried by two people

Liabilities & Limitations – Accidental Damage
We strive to take care of your goods whilst loading, in transit and unloading, we are not liable for and will pay no compensation for any accidental loss or damage to your goods or property.

We suggest you obtain insurance cover for your move either your home/general insurance company or we recommend EZImove www.ezimove.com or CARTS Removals & Storage Insurance www.removalsinsurance.co.nz

“All work carried at either loading or unloading site will be carried out at “Owners Risk” .

Insurance is NOT provided as part of this Agreement, as provided for in the Contract and Commercial Law Act. THESE GOODS ARE TO BE CARRIED AT OWNER’S RISK. THIS MEANS THAT THE CARRIER WILL PAY NO COMPENSATION IF THE GOODS ARE LOST OR DAMAGED, UNLESS THE CARRIER INTENTIONALLY LOSES OR DAMAGES THEM.

This means that we are not liable for and will pay no compensation for any accidental loss or damage to your goods or property. We suggest you obtain insurance cover for your move.

Particularly note that damage caused by vehicles to lawns, driveways, footpaths, underground pipes, cables, sewerage and other underground installations is not covered. Should our staff be instructed by the property occupier, move initiator, consignor, consignee or Shipper, or any person acting on their behalf to drive, park or maneuver vehicles in or near an area where such damage is likely to occur, compliance with such instructions will not in any way involve the Company or its Insurers in responsibility for any subsequent damage which may be sustained. Such responsibility will rest solely in the hands of the Owner, Consignor, Consignee, Shipper or initiator.

Liabilities & Limitations – Expected Estimated Time of Arrivals at Job Locations
All work is carried out on a “best – effort” basis. Whilst we try our best to make it on time for every booking and delivery, we sometimes do inevitably incur delays outside our control. Please be aware estimated ETA time windows for arrival at jobs are exactly that, estimates. By contracting our services you are agreeing you understand delays can happen, and that 2 Men and a Truck Waikato Furniture Removals cannot be held liable for personal or business losses arising from such delays either directly or indirectly.

Loading and Unloading: Your Responsibilities
If agreed upon during the quoting process, it is your responsibility to help the driver load and unload or to provide a suitable person(s) to do so. If the customer or suitable person has agreed to assist with the job, please ensure you are physically fit and able to partake in this work. 2 Men and a Truck Waikato Furniture Removals accepts no responsibility for any injury or other physical problems that occur as a result of assisting with the job. Please ensure you only assist with the job if you are physically capable of doing so.

The driver is obliged to load and unload to the closest point to the front door only, he will not place items in specific rooms for you or rebuild dismantled items unless agreed and quoted for in advance.

Changes in Item Numbers, or actual size of item(s) to be moved:
You may incur extra charges if the actual amount of items on the day exceeds the amount of items that were included in your quote, a couple of boxes more would not normally cause an issue, however if you have under-estimated your items by more than this our man will add on an extra charge depending on the amount and size of items and time taken to load them. If you have grossly under-estimated or have been misleading about the amount, size or type of items you have, we have the right to refuse the extra items regardless of whether you are willing to pay extra charges.

Your packing Responsibilities
We accept no responsibility for damage or breakage to items that have been packed by customers, and have not been packed / protected by adequate means, furniture items should be wrapped in strong cardboard, to prevent extremities / knobs/ legs and the like sticking out and being damaged or causing damage to other items, it is the customer’s responsibility to provide insurance cover for your items. It is the customer’s responsibility to dismantle any unit/system/flat pack furniture and beds and this should be done before our arrival (unless dismantling is pre-arranged with us).

Waiting Time
Unless otherwise arranged, waiting time will be charged at the standard rate you have been quoted for your job. Waiting time includes; key collection, contract signing, late arrival of the customer, items not ready to load, customer not present at either end and any time when loading/unloaded ding is not taking place.

Awkward Access
You may incur extra charges if you have not informed us of awkward access. Awkward access can include, no vehicle access, no parking available in close proximity to the property and cramped stair and hallway conditions where large items of furniture such as sofas will not fit, more than one doorway and corridor to pass through, having to go through rear access over gates, via stairs, etc.
If you have not clearly explained access or have been misleading about the requirements in regards to loading/unloading your items, we have the right to refuse lifting any items where we feel the access, or weight or lifting requirements are not within safe limits for our staff.
It is the customer’s responsibility to ensure that items will fit in the new premises (eg: size of sofa and size of aperture). Our man will not remove doors or windows in such cases and it is up to the customer to organise a specialist if needed.

Verbal or threatening behavior
Verbal or threatening behavior will not be tolerated. If our staff is forced to leave the job because of abuse from the customer verbal or otherwise the customer will still be liable to pay in full.

Jurisdiction
These terms are governed by, and is to be interpreted in accordance with, the laws of New Zealand.
